1.1.The “Rightholder” means an individual or legal entity holding proprietary rights to use and dispose of the “MovieFan” mobile application and having placed the said application in mobile application stores in accordance with the applicable Application Placement Terms and Application Store Rules.
1.2.The “Application” means the “MovieFan” mobile application placed by the Rightholder in mobile application stores.
1.3.The “User” means a user of the “MovieFan” mobile application who has been duly registered and uses the Application.
1.4.The “Policy” means this Privacy Policy and Personal Data Protection Policy for users of the “MovieFan” mobile application.
2.1.This Policy is an official standard document of the Rightholder and determines the procedure for processing and protecting information about individuals who use the Application.
2.2.The purpose of this Policy is to ensure proper protection of information about Users, including their personal data, against unauthorized access and disclosure.
2.3.Relations concerning the collection, storage, distribution and protection of information about Users are governed by this Policy, other official documents of the Rightholder, and applicable law.
2.4.The current version of the Policy, which is a public document, has been developed by the Rightholder and is available to any Internet user via the hyperlink “Privacy Policy and Personal Data Protection Policy for Users of the MovieFan Mobile Application.”
The Rightholder may amend this Policy. When amendments are made, the Rightholder shall notify Users by publishing a new version of the Policy at the permanent address: https://mauris.info/files/movie_fan_privacy_policy/ no later than 10 days before the relevant amendments enter into force. Previous versions of the Policy are stored in the Rightholder’s documentation archive.
2.5.This Policy has been developed and is used in accordance with the Terms of Use of the “MovieFan” mobile application, available online at: https://mauris.info/files/movie_fan_terms_of_use/.
2.6.By using the Application, the User expresses consent to the terms of this Policy.
2.7.If the User does not agree with the terms of this Policy, use of the Application must be discontinued immediately.
3.1.When providing services related to the use of the Application, the Rightholder, acting reasonably and in good faith, assumes that the User:
– has all necessary rights allowing the User to launch and use the Application;
– provides accurate information about themselves to the extent necessary to use the Application;
– understands that information made available as a result of the User’s use of the Application may become accessible to other Users of the Application and may be copied and distributed by such Users;
– understands that certain types of information provided by the User to other Users while using the Application cannot be deleted by the User personally;
– has reviewed this Policy, agrees to it, and accepts the rights and obligations set forth herein.
3.2.The Rightholder does not verify the accuracy of information received (collected) about Users.
The Rightholder processes information about Users, including their personal data, solely for the purpose of fulfilling the Developer’s obligations to Users in connection with the use of the Application.
The Rightholder processes information about Users, including:
5.1.Personal data provided by Users when creating and managing a mobile account and required to use the Application: name, gender, date of birth, profile photo, and email address;
5.2.Information provided by Users when using the Application and additional or special services within the Application, in particular, a nickname and password.
5.3.Information obtained by the Rightholder as a result of Users’ actions while using the Application.
6.1.Personal data is processed on the basis of the following principles:
a) lawfulness of the purposes and methods of personal data processing and good faith;
b) compliance of the purposes of personal data processing with the purposes predetermined and declared when the personal data was collected, as well as with the Rightholder’s authority;
c) compliance of the scope and nature of the personal data being processed and the methods of personal data processing with the purposes of processing;
d) inadmissibility of combining databases containing personal data that were created for mutually incompatible purposes.
6.1.1.Conditions and Purposes of Personal Data Processing
The Rightholder processes the User’s personal data with the User’s consent for the purpose of providing services related to the use of the Application.
6.1.2.Collection of Personal Data
The User’s personal data specified in Clause 5.1 of this Policy is transferred to the Rightholder with the User’s consent. The User’s consent to the transfer of personal data to the Rightholder is provided through conclusive actions upon the User’s first download of the Application and creation of an account.
6.1.3.Storage and Use of Personal Data
Users’ personal data is stored exclusively on electronic media and processed using automated systems.
6.1.4.Transfer of Personal Data
Users’ personal data is not transferred to any third parties except in cases expressly provided for by this Policy.
Users’ personal data may be provided at the request of state authorities (local self-government authorities) in the manner prescribed by law.
6.1.5.Destruction of Personal Data
The User’s personal data is destroyed in the following cases:
– when the Rightholder deletes information posted by the User at the User’s request;
– when the Rightholder deletes information posted by the User in cases established by the Terms of Use of the “MovieFan” mobile application, as well as by applicable law.
6.2.Since the Application is one of the means of communication and maintaining relationships with existing and new acquaintances, the following information may be available to other Users of the Application:
6.2.1.the User’s name;
6.2.2.the User’s profile photo;
6.2.3.information about the User’s use of the Application, as well as the User’s actions while using the Application.
7.1.Users have the right to:
7.1.1.freely access information about themselves, free of charge, by downloading the Applications they use;
7.1.2.independently make changes and corrections to information about themselves using the Application’s tools, provided that such changes and corrections contain current and accurate information;
7.1.3.request that the Rightholder delete information about them;
7.1.4.upon request, obtain from the Rightholder information concerning the processing of their personal data.
The Rightholder takes technical, organizational and legal measures to protect Users’ personal data against unlawful or accidental access, destruction, alteration, blocking, copying, distribution, as well as other unlawful actions. A description of the relevant technical, organizational and legal measures is contained in the Rightholder’s internal regulations.
This Policy does not apply to the actions and Internet resources of third parties.
The Rightholder is not responsible for the actions of third parties who, as a result of using the Application, gain access to information about the User which, by the nature of the Application, is available to any Internet user. The Rightholder recommends that Users take a responsible approach when deciding how much information about themselves to make available in the Application.
10.1.Users may send requests to the Rightholder, including requests concerning the use of their personal data as provided for in Clause 7.1.4 of this Policy, at: [email protected].
10.2.A request submitted by a User must contain the following information:
– a screenshot of the primary identification document of the User or the User’s representative;
– information confirming the User’s relationship with the Rightholder (in particular, information about downloading the Application, a screenshot of the Application screen, the nickname used by the User while using the Application, etc.).
10.3.The Rightholder undertakes to review and respond to a User’s request within 30 days from the date the request is received.
10.4.All correspondence received by the Rightholder from Users is classified as restricted-access information and shall not be disclosed without the User’s written consent. Personal data and other information about the User who submitted a request may not, without the User’s specific consent, be used for any purpose other than responding to the subject of the request, except in cases expressly provided for by law.
